LEGAL WARRANTY

 

1. Information about the Legal Warranty           

You are entitled as a "consumer customer", to benefit from the legal warranty envisaged by articles 128- 132 of Legislative Decree 206/2005 (Consumer Protection Act).

Rubinetteria.com is liable for conformity defects present at the time of delivery of the goods which become apparent within 24 months (2 years) from the date of their delivery. Any conformity defect becoming apparent within this period must be reported within 2 months of the date of its discovery.

In the event of a conformity defect, you are entitled to restoration of the conformity of the goods through repair or replacement, at no cost to you. You may ask the vendor to repair the product or to replace it, at your own discretion, at no cost to you in either case, unless the remedy requested is objectively impossible or is disproportionately expensive compared to the alternative. Repairs or replacements must be carried out within a reasonable time after your request; the average time for return of the product is 24 days. If the vendor is unable to return the repaired product within the maximum term of 60 days, you may request one of the alternative remedies (replacement, termination of the contract or reduction of the price).

The Italian Consumer Protection Act (articles 128-135) enforces a Legal Warranty of 24 months on the sale of consumer goods between retailers and consumers.

The retailer is liable in relation to consumers (natural persons not purchasing for any business, trade, craft or professional activities) for conformity defects with regard to all products sold on rubinetteria.com.

In the event that the warranty requires return of the product, it must be returned at your expense to ACQUATICA Spa - Via Rodi 1 c/d – 25033 COLOGNE (Brescia, Italy).

The 24 month Legal Warranty does not apply to products purchased with invoice and VAT registration number by professionals and businesses.

 

2. Times and procedures for exercising the Legal Warranty

You must notify Rubinetteria.com in writing by email to info@rubinetteria.com stating the order number, the product and the product's defect.

You must prepare the product for shipment by packaging it carefully, preferably in the original pack, complete with everything which it originally contained, including all accessories and the instruction manual.

The carrier will contact the customer to arrange collection of the product (inability to contact the customer by telephone will delay collection of the product).

The vendor will send the product for any repairs to the Service Centre authorised by the manufacturer.

The legal warranty does not apply to products which you have repaired, modified or in any way altered.

Under no circumstances shall the legal warranty apply if the defect is caused by negligence, misuse, insufficient care in the use or maintenance of the product, or connection of the product to electrical or any other systems which do not comply with the relevant standards.

 

3. Conformity defects

There is a conformity defect if the product:

is not fit for its normal purpose,

does not conform to the description or does not have the qualities described by the vendor,

does not provid3 the normal qualities and performance of a product of the same type,

is not fit for the specific purpose desired by the consumer if the vendor was made aware of this at the time of purchase and agreed to it.

Rubinetteria.com is not liable in the event of non-substantial differences between the goods purchased and their illustrations and the text descriptions published on the www.rubinetteria.com website.

 

4. What do you need to report a defect in the product?

To report any defect in the product purchased on rubinetteria.com and benefit from the legal warranty, you will have to show the fiscal document covering the purchase (invoice). So remember to keep it as proof of purchase for at least two years.

 

5. Consumer's rights

 

In the event of a conformity defect duly reported within the term granted you are entitled:

  • first and foremost, to repair or replacement of the goods, as you prefer, unless the remedy requested is impossible or disproportionately expensive compared to the alternative;
  • otherwise (if the first two remedies are impossible or disproportionately expensive, or have not been provided within reasonable terms, or if previous repairs or replacements have caused you serious inconvenience), to request a reduction in the price or the termination of the contract.

The remedy requested is "disproportionately expensive" when it involves unreasonably high expenses for the vendor compared to the alternatives, bearing in mind the value of the undamaged product, the size of the defect and the possibility of adopting alternative remedies without serious inconvenience to the consumer.

Repairs or replacements must be carried out within a reasonable time after your request.

Service times depend on the Service Centre, and generally vary according to the type of product and the nature of the defect.

The average time for return of the repaired product by the vendor is 24 days. If the vendor is unable to return the repaired product within the maximum term of 60 days, you may request one of the alternative remedies (replacement, termination of the contract or reduction of the price).

 

The vendor will:

  • inspect the product to establish whether the problem can be resolved quickly and easily, or whether there are obvious reasons why the Legal Warranty does not apply (e.g. expiry of the coverage period, or damage caused by accidents or by the consumer himself);
  • register the product and the customer for the purposes of the service process;
  • the vendor will send the product for the appropriate checks and any repairs to the Service Centre authorised by the manufacturer; or replace the product if the repair is impossible or disproportionately expensive;
  • continually monitor the progress of the repair and, if necessary, pressurise the Service Centre to perform the repair within an appropriate time;
  • manage the logistics process for return of the product by the Service Centre.

 

If the Service Centre does not confirm that the product has a conformity defect, the vendor will notify you of the Service Centre's quotation.

You will be able to decide whether or not to have the product repaired at your own expense. In this case, any transport costs and the cost of diagnosing the defect claimed by the Service Centre will be charged to you.

 

To find out how the repair is progressing, you can contact the rubinetteria.com after-sales service. The vendor will notify you by email or by telephone when the product is ready for collection.

 

If you consider this is in your best interests, you can decide to implement the Manufacturer's Warranty and take the product straight to the Service Centre.

 

To further protect its customers, the vendor has notified manufacturers and their Authorised Service Centres that in the event of a conformity defect in the product covered by the Legal Warranty, for which the Manufacturer's Warranty does not apply, all repair or replacement expenses will be charged to the vendor further to submission to it of:

            the Service Centre report proving the conformity defect;

            the Service Centre invoice for the repair/replacement costs;

            the proof of purchase of the product on rubinetteria.com.

 

LEGAL WARRANTY FOR NON CONSUMER CUSTOMERS

NON consumer customers have the legal warranty rights established by the Italian Civil Code. This warranty requires NON consumer customers to report any faults or defects discovered in the product purchased to Rubinetteria.com within 8 (eight) days of discovery; otherwise, warranty cover will be forfeited.

The above Legal Warranty is valid for the maximum period of 12 (twelve) months after delivery of the product. After this term, Rubinetteria.com will no longer be liable for any faults or defects. In order to benefit from the Warranty, NON consumer customers must provide documentary proof of purchase and actual delivery of the product.

 

COMMERCIAL WARRANTY

In addition to the Legal Warranty, all products on sale on this website are also covered by the Manufacturer's Warranty.

The Manufacturer's Warranty is combined with but does not replace the 24 month Legal Warranty (12 months for NON consumer customers) which applies in all cases, on the legal terms.

The duration of this warranty, its territorial cover and the procedures for exercising the rights are provided on the special form issued by the manufacturer.
